Terms of Service

These Terms of Service ("Terms") govern your use of the P247 mobile application and the website at p247.io (together, the "Service"), operated by Commit-IT (ABN 60 137 471 615) ("P247", "we", "us"), based in New South Wales, Australia.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

P247 is a performance intelligence platform for athletes. It collects health and fitness data from wearable devices and manual inputs, analyses that data using statistical models and AI, and delivers personalised daily performance briefs, trend analysis, and coaching recommendations.

2. Eligibility

• You must be at least 16 years old to use the Service
• You must provide accurate information when creating your account
• You are responsible for maintaining the security of your account credentials

3. Your Account

• One account per person. Do not share your account with others.
• You are responsible for all activity that occurs under your account
• Notify us immediately at support@p247.io if you suspect unauthorised access
• We may suspend or terminate accounts that violate these Terms

4. Health Data and Consent

• The Service requires access to health and fitness data to function. You grant us permission to collect, store, and process this data when you connect your devices or enter information manually.
• You can revoke access to any data source at any time through the app settings or your device's health permissions.
• Revoking access may limit or disable parts of the Service that depend on that data.

5. Not Medical Advice

P247 is not a medical device, medical service, or healthcare provider.

• The Service provides performance and training insights for informational purposes only
• Recommendations generated by P247 (including AI coaching) are not medical advice, diagnosis, or treatment
• Do not use P247 to make medical decisions. Always consult a qualified healthcare professional for medical concerns.
• If you experience symptoms such as chest pain, dizziness, shortness of breath, or any medical emergency, seek immediate medical attention. Do not rely on P247.
• P247 does not replace professional coaching, physiotherapy, dietetics, or sports medicine

6. AI-Generated Content

• P247 uses artificial intelligence to generate daily briefs, coaching messages, and performance analysis
• AI-generated content is based on your data and general sports science principles, but it is not infallible
• AI recommendations may be inaccurate, incomplete, or not suited to your individual circumstances
• You are responsible for evaluating and deciding whether to follow any recommendation
• We continuously work to improve accuracy, but we do not guarantee the correctness of any AI output

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access other users' accounts or data
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers) to access the Service without our written permission
• Interfere with the Service's infrastructure or security
• Resell, sublicense, or redistribute the Service or its outputs
• Upload malicious content or data designed to disrupt the Service

8. Intellectual Property

• The Service, including its design, code, algorithms, analysis models, content, and branding, is owned by P247 and protected by copyright and intellectual property laws
• You retain ownership of your personal data and any content you submit (check-in notes, feedback)
• By using the Service, you grant us a limited licence to process your data as described in our Privacy Policy
• We do not claim ownership of your health data

9. Third-Party Services

P247 integrates with third-party platforms including Strava, Garmin Connect, Whoop, Oura, and Apple HealthKit. Your use of these integrations is subject to those platforms' own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Availability and Changes

• We aim to keep the Service available at all times but do not guarantee uninterrupted access
• We may update, modify, or discontinue features of the Service at any time
• For material changes that affect your rights, we will provide reasonable notice via email or in-app notification
• Continued use of the Service after changes constitutes acceptance of the updated Terms

11. Subscription and Payment

P247 may offer free and paid subscription tiers. If you subscribe to a paid plan:

• Payment is processed through Apple's App Store. Apple's terms and refund policies apply.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription through your Apple ID account settings
• We do not process or store your payment card information directly

12. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated recommendations will be accurate or appropriate for your situation
• P247 is not liable for any injury, health issue, training setback, or other harm arising from your use of or reliance on the Service
• Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or AUD $100, whichever is greater
• We are not liable for indirect, incidental, consequential, or punitive damages

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud, death, or personal injury caused by negligence, or any rights under the Australian Consumer Law that cannot be excluded.

13. Indemnification

You agree to indemnify and hold harmless P247 from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

14. Termination

• You may delete your account at any time through the app or by contacting support@p247.io
• We may suspend or terminate your account if you violate these Terms
• Upon termination, your right to use the Service ends immediately. Your data will be deleted in accordance with our Privacy Policy.

15. Governing Law and Disputes

• These Terms are governed by the laws of New South Wales, Australia
• Any dispute will first be attempted to be resolved through good-faith negotiation
• If negotiation fails, disputes will be submitted to the courts of New South Wales, Australia
• If you are an EU consumer, nothing in these Terms affects your right to bring proceedings in your local courts or rely on mandatory consumer protection laws in your jurisdiction

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
